Terms of Service

These Terms of Service ("Terms") govern your use of the PlantPurges platform operated by PlantPurges LLC ("we", "us", "our"). By creating an account or using our services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using PlantPurges, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the platform.

2. Description of Service

PlantPurges is an all-in-one selling platform designed for plant sellers on Facebook. Our services include:

• Creating and sending invoices with payment links.
• Accepting payments through Stripe, including comment-to-pay automation.
• Generating shipping labels and tracking packages via integrated carriers.
• Facebook automation for syncing posts and managing sales workflows.
• Analytics, customer management, and marketing tools.

3. Account Registration

You must be at least 18 years old to create an account. You agree to provide accurate, complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Fees

• Subscription: $20 per month. Your subscription renews automatically each month until cancelled.
• Payment processor fees: Standard Stripe processing fees (approximately 2.9% + $0.30 per transaction) are charged by Stripe directly.
• Platform fee: None — sellers keep 100% of every sale (minus standard payment processor fees).

All fees are non-refundable except where required by law. We reserve the right to change fees with 30 days' notice.

5. Payment Processing

Payment processing is provided by Stripe and is subject to the Stripe Connected Account Agreement and Stripe Terms of Service. You must complete Stripe onboarding to receive payments through the platform.

6. Seller Responsibilities

• Only sell products that are legal in your jurisdiction and the buyer's jurisdiction.
• Provide accurate and truthful product listings, including descriptions, photos, and pricing.
• Ship orders in a timely manner as communicated to the buyer.
• Comply with all applicable laws regarding the sale and shipment of plants and related products.
• Handle customer disputes and returns in good faith.

7. Prohibited Content

You may not use PlantPurges to sell or promote:

• Illegal plants, controlled substances, or products prohibited by law.
• Invasive species where prohibited by regulation.
• Non-plant items that violate our platform policies.
• Counterfeit or misrepresented products.
• Any content that is defamatory, fraudulent, or otherwise objectionable.

We reserve the right to remove content or suspend accounts that violate these Terms.

9. Intellectual Property

The PlantPurges platform, including its design, code, features, and branding, is the intellectual property of PlantPurges LLC. You retain ownership of content you upload (listings, photos, etc.) and grant us a limited license to display and process it as necessary to operate the platform.

10. Limitation of Liability

To the maximum extent permitted by law, PlantPurges LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim. The platform is provided "as is" without warranties of any kind.

11. Termination

You may cancel your account at any time. We may suspend or terminate your account if you violate these Terms or engage in activity that harms the platform or other users. Upon termination, your right to use the platform ceases immediately.

12. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

13. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law provisions. Any legal proceedings shall be brought exclusively in the courts of the State of Florida.
